Terms of Sale
These terms of sale define the procedure of ordering, payment, delivery and return or complaint of goods offered on our internet pages. The supplier (seller) of the products offered in the web shop brightpdrn.eu (hereinafter referred to as «goods») is Kaia Form & Flora d.o.o., and the buyer of the goods is a visitor of the internet catalogue who selects at least one product, fills in the electronic order form and sends it to the seller

Ordering
Goods are ordered via an electronic form and by telephone. The buyer must fill in a Profile with basic data for billing and delivery of the desired products and will be notified by electronic mail about the completed order.
After selecting a product you can click on its details and find out everything about it and view it better, and if you want to buy it, you simply click on the cart and it will immediately be placed in it. In the cart you can choose quantities, as well as give up the purchase. At any moment your cart is visible and available to you and you can calmly continue browsing our showcase. Upon completion of the purchase, return to the cart and select finish order. A notification of a successfully completed purchase arrives to your e-mail address.

Payment
Payment of products and services on this website can be made via credit and debit cards (Visa, Mastercard, American Express and other supported cards) and via digital payment methods such as Apple Pay and Google Pay. Processing of all payments is carried out via the secure system for payment processing Stripe.

The seller does not store data about customers’ cards. All payment data is processed in accordance with the security standards of the payment service provider Stripe.

Delivery
For delivery within the Republic of Croatia we use the services of HP Express.

Delivery within Croatia amounts to 4,99 EUR
Delivery period within Croatia: 3 to 7 working days

For foreign orders delivery amounts to 7,99 EUR, and delivery is carried out via international delivery services.

Delivery time: 3 to 7 working days

After a successfully received order, you will receive the order confirmation via e-mail.

Return and complaints
The right to unilateral termination of the Contract (return of the order) without stating a reason is granted to all customers of boroviti.eu within 14 days from receipt of the shipment. In order for the Buyer to exercise the right to unilateral termination of this Contract (return), the Buyer must inform the Seller of their decision on unilateral termination of the contract before the expiry of the deadline and that by means of an unambiguous statement sent by post or electronic mail, in which they will state their name and surname, address, telephone number, telefax or electronic mail address. The request for unilateral termination of the Contract is sent to the e-mail info@boroviti.eu or by post to the address Kaia Form & Flora d.o.o., Martićeva ulica 10, 10000 Zagreb.
Confirmation of receipt of the notice of unilateral termination of the contract will be delivered by the Seller to the Buyer, without delay, by electronic mail. All users bear the costs of returning the goods themselves.

After the Buyer requests a return the staff of the Seller will contact him and give instructions for carrying out the return. In order for the return to be accepted returned goods must be unworn, undamaged and in original packaging. If the goods are not in appropriate condition (unworn, undamaged and in original packaging), the Seller will not be able to accept the return request and the Buyer will have to pay postage in the amount of 4 EUR so that the goods are sent again to his home address.

If by inspection of the product the Seller determines that the returned goods are in appropriate condition, he will return the full amount that the Buyer paid to the current account or credit card, that is in the same way in which the Buyer made the payment, no later than within 14 days from receipt of the decision on unilateral termination of the contract. The refund may be carried out by the Seller only after the goods have been returned to him, it is considered that the Buyer has fulfilled his obligation on time if before the expiry of the above stated deadline he sends or hands over the goods to the Seller, that is to the person whom the Seller authorizes for receiving the goods. All items the Buyer can return to the goods at Martićeva ulica 10, 10000 Zagreb, after the approved return request.
The Buyer undertakes to return the goods within two working days from approval of the request.

If after 20 days from submission of the order you do not receive any notification about the status of the order nor delivery, please contact info@boroviti.eu so that we can undertake actions so that the shipment is found or a replacement is sent.

Online dispute resolution
If you have a problem with goods or a service that you purchased on the internet, on this platform you can submit a complaint. That complaint will then be resolved by an independent dispute resolution body.
In case of the need to submit complaints and resolve consumer disputes online you can use the Platform for online consumer dispute resolution (ODR Platform).

Notice on the manner of submitting consumer complaints
In accordance with Article 10 of the Consumer Protection Act (Official Gazette No.41/14) we inform consumers that dissatisfaction in relation to a purchased product or provided service may be expressed by a complaint in written form whereby we will without delay confirm in writing the receipt of the complaint. Kaia Form & Flora d.o.o., Martićeva ulica 10, 10000 Zagreb, Croatia, OIB: 27883204594 (hereinafter in the text: brightpdrn.hr) in performing its activity, collects and processes personal data respecting all relevant laws and regulations. We at Kaia Form & Flora d.o.o. undertake that we will keep the privacy and secrecy of personal data of all our visitors and customers, in accordance with the Electronic Commerce Act (Official Gazette No. 173/2003 , 67/2008 and 36/2009) Please read this Statement carefully in order to find out how we collect, process, protect or in any other way use your personal data. We undertake to apply maximum security measures for the purpose of protecting the interests of customers and preventing possible misuse of information. In the process of realization of the purchase we will use only the information that is necessary. All employees of Kaia Form & Flora d.o.o. and business partners are contractually obliged to respect the principles of protection of privacy and data secrecy. We collect only necessary, basic data about customers/users and inform visitors and customers about the manner of use of such data. We regularly give customers the possibility of choice about the use of their data, including the possibility of deciding whether or not they want their name to be removed from lists used for marketing campaigns. Personal data of customers are stored in the information system of the company Kaia Form & Flora d.o.o. and are kept in a secure place and are available only to employees of Kaia Form & Flora d.o.o. to whom these data are necessary for providing quality service to our customers. The use of data is limited to communication with customers for the purpose of performing sales transactions, and informing users about news and benefits that are available to them via our website. Kaia Form & Flora d.o.o. guarantees that personal data of users of the Website of Kaia Form & Flora d.o.o. will never be given for inspection and use to a third party, without prior explicit consent of the user. This does not apply to requests for access to data by authorized services of the executive state authority of the Republic of Croatia for the purposes of business control. We collect only those personal data that you voluntarily provide to us and only for the purposes stated in these personal data protection rules. We do not require you to send us those data in order to enable you access to our pages and we do not ask you to reveal more data than is truly necessary for participation in some activity on our pages. The same data are used for the purpose of concluding a contract, and for the purpose of familiarizing www.boroviti.eu with the purchasing habits of customers, as well as for informational purposes, and for the purpose of promotion of services and products of the seller. www.boroviti.eu undertakes to keep the privacy of personal data of all Customers, and will treat them in accordance with the Personal Data Protection Act, i.e. other applicable regulations. By registration you confirm the accuracy and completeness of the data stated in the form and give explicit consent that Kaia Form & Flora d.o.o. may, in accordance with the provisions of the Personal Data Protection Act (Official Gazette No. 103/2003 and 118/2006) and the Electronic Commerce Act (Official Gazette No. 173/2003 , 67/2008 and 36/2009) , process personal data indicated in the form for the purposes of its records and providing services of informing about new products and services.

Data Controller
Kaia Form & Flora d.o.o. is the controller of personal data in accordance with the law and regulations on personal data protection. Kaia Form & Flora d.o.o. as the controller of personal data determines the purpose and means of processing personal data and is responsible for keeping and using personal data in paper and/or electronic form. Personal Data We Collect
Personal data is any data that relates to an individual whose identity is known or can be determined. An individual whose identity can be determined is a person who can be identified directly or indirectly, especially with the help of identifiers such as name, identification number, location data, network identifier or with the help of one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual. We collect your personal data only when you voluntarily provide such information to us. We collect data about you when you fill in a web form or when subscribing to the newsletter. You should bear in mind that non-personal information and data can be automatically collected via our Internet servers or by using “cookies”. The reasons for which we process personal data for the purpose of concluding and fulfilling contractual obligations are:

• Processing orders via the online shop and delivery/shipment of ordered products
• Transmission of commercial communications via electronic mail, mobile telephony or traditional mail that is courier delivery

Legal basis of personal data processing
By entering his personal data and confirming (by clicking) acceptance of the Terms of purchase and this Privacy Statement, the Buyer enters into a contractual relationship which is the basis for the purchase of products and services by the choice of the Buyer on the website www.boroviti.eu, and which is contained in the terms of purchase and therefore the processing of such personal data is lawful because actions are undertaken at the request of the Buyer for the purpose of realization of the purchase of products and services ordered by the Buyer.

Receiving marketing campaigns on e-mail (newsletter)
If you decide to subscribe to our newsletter list, the e-mail address that you send to us is forwarded to a software platform that provides us with e-mail marketing services. The e-mail address that you send will not be stored in our own database or on any of our internal computer systems. Your e-mail address remains within the database of the stated platform as long as we continue to use the services of that platform for e-mail marketing or until you request unsubscription from the newsletter list. You can do this by unsubscribing using the unsubscribe links that are located in all newsletters that we send to you or by requesting unsubscription via our contact e-mail address. A user that subscribes for receiving notifications about products and promotions by entering his data on the website www.brightpdrn.eu and by double confirmation of correctness of the e-mail address gives consent for processing of his personal data.

Communication of data to third parties
Kaia Form & Flora d.o.o. will not share personal data of the Buyer or User with other parties except in the cases stated in the following points and in situations when this is required by positive regulations. Kaia Form & Flora d.o.o. will, when required by the realization of the contract for purchase of products or services by order of the Buyer, share personal data of the Buyer with:

Service providers of goods distribution with whom it has a permanent contract and for that purpose for fulfillment of orders, delivery of packages, sending land mail and e-mail.

• The service provider of distribution may request from the Buyer to present his personal identification card at the moment of delivery of the package during personal takeover of the goods, all for the purpose of realization of the service of delivery of the package and records about who took over the package. If the Buyer refuses to provide these data, the package will not be handed over to him.

• The service provider of distribution may send to the Buyer’s e-mail address a link for tracking the status of the shipment.

Processing of personal data in the process of payment by credit and debit cards
Kaia Form & Flora d.o.o. at the moment of payment on the website www.boroviti.eu, as a condition for payment of products and services by credit or debit cards requests the consent of the Buyer for activation of the payment process via Stripe, contractual partner of Kaia Form & Flora d.o.o. and Processor of personal data. For this purpose personal data of the Buyer (name and surname of the Buyer, address of the Buyer, data from the Buyer’s card) are temporarily stored with Stripe, which stores these data in accordance with PCI DSS certification, the highest level of protection and storage of confidential data. Employees of the www.brightpdrn.eu internet shop at no moment have access to your credit card number, only the number of the authorized transaction is available to them. Card data are not stored in our system but the credit card number is directly checked and authorized in the authorization center of the card company. Do not enter the credit card number anywhere except in the field intended for that purpose, do not send it by e-mail nor via the contact form. Kaia Form & Flora d.o.o. does not assume responsibility for any possible direct or indirect damages that Customers may suffer due to temporary, partial or complete unavailability of the WSPay™ service.

Deletion of personal data (right to be forgotten, withdrawal of consent)
In the event that the Buyer does not wish that the seller in any way further processes his data, and requests deletion of data about him, he must notify the seller of this, and that via an e-mail message to the e-mail address info@boroviti.eu

Right to object
If despite all undertaken measures for protection of personal data you consider that you have grounds for objection, contact the Data Controller via e-mail address info@boroviti.eu. You can also submit a complaint regarding the processing of your personal data to the supervisory authority Agency for Personal Data Protection (AZOP).

Access and correction of personal data
The Buyer and the User at any moment have the possibility of access to their personal data upon registration on the website and by accessing “My data” where the Buyer can revise their personal data that they have shared with Kaia Form & Flora d.o.o. The Buyer and the User may request and obtain from Kaia Form & Flora d.o.o. complete information about the personal data that are stored, as well as correction of the same by sending an e-mail message to the e-mail address of the Data Controller: info@boroviti.eu

Period of storage of personal data
We will keep your data for as long as necessary for the purpose for which we process them. The criterion on the basis of which we determine the period of storage of personal data is precisely the purpose of collection and the time period in which you wish us to provide our services to you.

Security measures for protection of personal data
Encryption Your data and all pages of the www.brightpdrn.eu internet shop are protected by using the Secure Socket Layer (SSL) protocol with 128-bit encryption. SSL encryption encrypts data in order to prevent unauthorized access during their transfer.
